Scope
On 17 July 2025, the European Commission launched a consultation on the upcoming Digital Fairness Act. The Act aims to strengthen the EU’s online consumer protection rules.
The scope of the Digital Fairness Act is still being developed. The Commission has indicated that it may address concerns such as unethical techniques and commercial practices related to manipulative interface design (dark patterns), misleading marketing by social media influencers, addictive design of digital products and online profiling.
The initiative also seeks to ensure a level playing field for online traders, facilitate enforcement, and potentially reduce legal and administrative burdens for businesses.
Relevance
The Digital Fairness Act will complement the existing EU digital regulatory framework, including the GDPR, the Digital Services Act, and the Digital Markets Act.
Draft legislation is expected in Q3 2026.
